Texas Medical Expert Testimony: Rule 702 Reliability

What Makes Medical Expert Testimony Reliable Under Texas Evidence Standards?

In a Texas courtroom, an impressive résumé may open the door to expert testimony, but it does not carry an opinion across the finish line.

A physician, chiropractor, biomechanical expert, radiologist, or other specialist may have decades of experience. Yet when that expert offers an opinion about whether a collision caused a disc injury, whether trauma aggravated a pre-existing condition, or whether an imaging abnormality explains a patient’s neurological symptoms, the court can look beyond credentials and ask a more demanding question:

How did the expert get from the evidence to the conclusion?

That question sits at the center of reliable medical expert testimony.

Texas Rule of Evidence 702 permits testimony from a witness qualified through knowledge, skill, experience, training, or education when the witness’s specialized knowledge will help the trier of fact understand the evidence or determine a fact in issue. Texas courts have developed additional case law emphasizing relevance, reliability, adequate factual foundations, and a defensible connection between the expert’s methodology and the opinion ultimately offered (Texas Rules of Evidence, 2026; E.I. du Pont de Nemours & Co. v. Robinson, 1995).

For researchers, clinicians, attorneys, and medical expert witnesses, this ruling creates an important distinction: an explanation can be scientifically plausible without being sufficiently supported to constitute a reliable expert opinion.

Texas Medical Expert Testimony: Rule 702 Reliability

Texas Rule of Evidence 702: The Starting Point

The current Texas Rules of Evidence, effective July 2, 2026, state that a witness qualified by “knowledge, skill, experience, training, or education” may provide expert testimony when specialized knowledge will help the factfinder understand evidence or decide a disputed fact (Texas Rules of Evidence, 2026).

That language establishes two essential ideas.

First, expertise must relate to the actual subject of the proposed opinion. A professional license does not automatically qualify someone to testify on every healthcare issue.

Second, the opinion must actually help the judge or jury. Technical language without explanatory value is not the purpose of expert testimony.

The surrounding evidence rules make the foundation even more important. Rule 703 governs the facts and data on which experts may reasonably rely, while Rule 705(c) bars an expert opinion when its underlying facts or data do not provide a sufficient basis for the opinion (Texas Rules of Evidence, 2026).

That is why reliable testimony begins long before a deposition.

It begins with reliable records, examinations, measurements, diagnostic reasoning, imaging when clinically appropriate, relevant medical literature, and careful consideration of competing explanations.

Qualifications Must Match the Question

Expert qualifications are not simply a collection of degrees.

The relevant inquiry is whether the witness has meaningful expertise concerning the particular issue on which the opinion is offered.

A chiropractor experienced in traumatic musculoskeletal injuries may be well positioned to discuss examination findings, range-of-motion loss, musculoskeletal dysfunction, rehabilitation response, and other matters falling within professional training and scope. A radiologist may have more specialized expertise concerning a subtle imaging interpretation. A biomechanical engineer may be required when an opinion depends on sophisticated calculations involving vehicle dynamics or occupant loading.

The point is not that one profession is categorically superior to another. The issue is fit.

In Gammill v. Jack Williams Chevrolet, Inc. (1998), the Texas Supreme Court emphasized that the party offering expert testimony must establish expertise regarding the particular matter under consideration. The court also extended reliability analysis beyond purely scientific testimony to technical and other specialized expert knowledge.

For attorneys screening experts, the practical question becomes: What precisely is this witness asked to establish, and what training or experience qualifies that person to do so?

The Robinson Reliability Factors

The Texas Supreme Court’s decision in E.I. du Pont de Nemours & Co. v. Robinson remains foundational in evaluating scientific expert testimony. The Court identified several nonexclusive considerations to help determine whether a scientific methodology is reliable.

Those considerations include:

  • whether the theory or technique can be and has been tested;
  • how much the technique depends on the expert’s subjective interpretation;
  • whether the theory has undergone peer review or publication;
  • the technique’s known or potential error rate;
  • whether the relevant scientific community generally accepts the underlying theory or technique; and
  • whether the theory or technique has legitimate uses outside litigation.

(Robinson, 1995; Havner, 1997).

These are not mechanical boxes that must all be checked in every medical case. Their usefulness depends on the nature of the testimony.

Clinical medicine frequently requires judgment rather than a laboratory experiment. For example, a physician assessing whether trauma aggravated lumbar radiculopathy may synthesize patient history, examination findings, imaging, symptom distribution, neurological findings, previous records, response to treatment, and competing diagnoses.

Reliability analysis therefore needs to examine the actual methodology appropriate to that clinical discipline rather than force every medical question into an experimental-science template.

Gammill and the “Analytical Gap”

One of the most important concepts in Texas expert-testimony law is the analytical gap.

An expert may begin with accurate facts and still reach an unreliable conclusion.

In Gammill, the Texas Supreme Court explained that testimony can fail when there is simply too great an analytical gap between the available data and the expert’s ultimate opinion (Gammill, 1998).

Consider a personal injury example.

A patient is involved in a rear-end collision. An MRI later reveals a cervical disc protrusion. The statement “the crash caused the disc protrusion because the MRI showed it afterward” may be plausible, but it is not necessarily a complete causal analysis.

The expert should consider additional questions.

Was there prior cervical imaging? Were similar symptoms documented before the collision? Did the patient experience a new symptom pattern after the event? Was the injury mechanism anatomically capable of producing or aggravating the diagnosed condition? Do examination findings correspond to the affected spinal level? Are there degenerative findings that provide an alternative explanation? Did the patient have an intervening injury?

Reliable methodology connects these pieces instead of jumping directly from chronology to causation.

Temporal Sequence Matters, but “After” Does Not Automatically Mean “Because Of”

Timing is often clinically important.

A previously asymptomatic patient who develops immediate neck pain, restricted movement, headaches, and upper-extremity neurological symptoms following a significant collision presents a different causal picture from someone whose symptoms appear months later after several unrelated events.

But temporal sequence alone does not establish causation.

Texas decisions have repeatedly recognized the danger of substituting correlation for a properly supported causal explanation. In Jelinek v. Casas (2010), the Texas Supreme Court reinforced the requirement that experts explain how the evidence supports the causal conclusion rather than asking the factfinder simply to accept the expert’s assertion. Later Texas decisions continue to cite Jelinek for the proposition that an expert must link conclusions to the underlying facts.

For a medical expert, chronology is therefore one element of the analysis—not the entire analysis.

Scientifically Plausible Is Not the Same as Well Supported

This distinction is especially important in causation testimony.

Scientific plausibility asks: Could this happen?

A well-supported opinion asks: Given this patient’s evidence, competing explanations, medical knowledge, and the limitations of the available information, how strongly does the evidence support the conclusion that it happened?

A rapid acceleration-deceleration event can plausibly injure cervical soft tissues. A fall can plausibly aggravate a lumbar disc disorder. Blunt trauma can plausibly injure a shoulder.

But possibility alone does not establish specific causation in an individual case.

The 2025 fourth edition of the Reference Manual on Scientific Evidence emphasizes that medical reasoning may consider biological plausibility, physiology, temporal relationships, clinical evidence, and epidemiological research. It also recognizes that clinical treatment decisions are often made under uncertainty, while courtroom causation questions may demand a more explicit, disciplined explanation of the evidence supporting the causal inference (National Academies of Sciences, Engineering, and Medicine [NASEM], 2025).

That distinction protects both science and patients.

It prevents an expert from overstating what a medical record proves while still allowing a clinician to explain a well-supported opinion when multiple pieces of evidence converge.

Reliable Medical Causation Requires Competing Explanations to Be Addressed

One hallmark of rigorous clinical reasoning is the willingness to test an initial hypothesis against alternatives.

A patient may have degenerative disc disease before an automobile collision. That does not automatically mean the collision caused nothing. Conversely, a collision does not automatically make every later symptom traumatic in origin.

The medically relevant question may instead be whether trauma caused a new injury, aggravated a pre-existing condition, accelerated symptoms, or produced no material change.

A defensible expert opinion should therefore account for meaningful alternatives such as prior trauma, age-related degeneration, systemic disease, neurological disease, previous symptoms, occupational exposures, sports activity, subsequent accidents, and other plausible explanations supported by the record.

The scientific literature similarly treats consideration of alternative explanations as an important component of causal inference. The fourth edition of the Reference Manual on Scientific Evidence discusses temporal relationships, biological plausibility, strength and consistency of associations, replication, alternative explanations, and related considerations when evaluating causation (NASEM, 2025).

The goal is not to prove that every conceivable alternative is impossible.

The goal is to show that relevant competing explanations were recognized and reasonably evaluated.

Objective Findings Strengthen the Foundation, but They Still Require Interpretation

Objective evidence may substantially strengthen a medical opinion.

Depending on the injury and clinical question, the evidence may include diagnostic imaging, neurological deficits, reflex changes, muscle weakness, sensory changes, orthopedic testing, quantified range-of-motion loss, electrodiagnostic studies, documented swelling, functional testing, or other reproducible clinical findings.

Yet an objective test does not interpret itself.

Correlate an MRI finding with the patient’s clinical presentation. A disc abnormality that does not correspond to symptoms or neurological findings may have a different evidentiary meaning from an imaging abnormality that closely matches the examination.

Similarly, a functional deficit should be interpreted within its clinical context.

Reliable testimony therefore depends on clinical correlation rather than the mere existence of a test result.

For readers exploring this issue in the context of injury cases, Dr. Jimenez’s discussion of El Paso injury causation and connecting accidents to documented injuries provides a related overview of biomechanics, diagnosis, objective findings, alternative explanations, and the limits of expert opinions.

Havner: Reliable Data Still Need Reliable Reasoning

Merrell Dow Pharmaceuticals, Inc. v. Havner (1997) is particularly important when medical causation depends on scientific studies or epidemiological evidence.

The Texas Supreme Court explained that an expert’s assurance that a methodology is valid is not enough. Courts may independently examine the underlying data. Moreover, even reliable underlying data cannot rescue an opinion if the expert draws conclusions through flawed methodology (Havner, 1997).

This principle reaches beyond toxic-tort litigation.

A clinician should not cite a study merely because its title seems helpful. The expert should assess whether the study population resembles the patient at issue, what the study measured, the effect size, the limitations, whether results have been replicated, and whether the study legitimately supports the proposed conclusion.

Evidence-based testimony requires more than references.

It requires understanding what those references can—and cannot—establish.

Treating Clinician Versus Litigation Expert

A treating clinician and a retained expert may approach a case from different starting points, but reliability requirements do not disappear because an opinion originated in treatment.

A treating clinician may possess a valuable longitudinal view of the patient. That clinician may have examined the patient repeatedly, observed neurological or musculoskeletal findings, reviewed imaging, monitored functional changes, and documented treatment response.

Those observations can be highly relevant.

But treatment history should not become a substitute for causal reasoning.

Texas authority has recognized that even a treating physician’s use of differential diagnosis does not automatically exempt the resulting causation opinion from reliability scrutiny. The methodology and its application still matter.

This is particularly important when testimony moves from “I diagnosed and treated this condition” to “this particular event caused this condition.”

Those are related—but analytically different—questions.

A Reliable Expert Should Be Able to Explain the Opinion Without Hiding Behind Credentials

The strongest medical experts generally make their reasoning easier to inspect, not harder.

They can explain what information they reviewed, which findings mattered, what alternative explanations they considered, what scientific principles they applied, where uncertainty remains, and why the available evidence supports their conclusion.

They also understand the limits of their expertise.

An expert who acknowledges uncertainty can be more scientifically credible than one who claims absolute certainty where medicine cannot provide it.

Modern expert-witness guidance likewise emphasizes objective record review, current scientific evidence, professional competence in the relevant subject, and avoidance of advocacy disguised as medical analysis. Medical experts are expected to provide scientifically grounded testimony rather than simply support whichever party retained them (Kopitnik & Nouhan, 2024).

Why Multidisciplinary Evaluation Can Improve the Medical Record

Complex injury cases often cross disciplinary boundaries.

Musculoskeletal injury may need to be considered alongside neurological findings, metabolic disease, prior degeneration, medication use, functional limitations, imaging findings, and systemic conditions. Coordinated evaluation can help distinguish issues that fall within different professional scopes and can reduce the temptation for one clinician to overextend beyond his or her area of expertise.

At Injury Medical Chiropractic and Functional Medicine Clinic in El Paso, Dr. Alex Jimenez, DC, APRN, FNP-BC, CFMP, IFMCP, is a dual-licensed Doctor of Chiropractic and board-certified Family Nurse Practitioner whose clinical work includes evaluating traumatic musculoskeletal and soft-tissue injuries. Dr. Maria Guadalupe Cardenas, MD, a board-certified internal medicine physician with more than four decades of experience, serves as medical director and collaborative physician. Clinic materials describe this integration of chiropractic, nurse-practitioner, medical, diagnostic, rehabilitation, and functional-medicine capabilities as a distinctive model in El Paso and as the only local clinic providing this particular integrated dual-scope approach in one location. Because exclusivity is a market claim, that statement should remain attributed to the clinic unless independently verified.

Readers who want more detail on the provider structure can review the clinic’s multidisciplinary staff and credentials, its overview of Dr. Jimenez’s board-certified nurse practitioner role, and the clinic’s page on integrative medical and diagnostic services.

What Attorneys Should Ultimately Look for in a Medical Expert Opinion

The central question is not whether the expert sounds confident.

The key question is whether the reasoning can withstand scrutiny.

A defensible medical opinion should show a traceable path from the patient’s history and objective findings to the diagnosis, from the diagnosis to the causal analysis, and from the causal analysis to the conclusion offered.

That path should remain understandable when opposing counsel asks why a different cause was rejected, why a particular study applies, why imaging matters, why previous symptoms do or do not alter the analysis, or where the expert’s professional scope begins and ends.

This is the practical lesson of Rule 702, Robinson, Gammill, and Havner.

Credentials, confidence, or plausibility alone do not create reliability. It is created when sufficient facts, appropriate expertise, defensible methodology, clinical relevance, and transparent reasoning converge.

  • For clinicians, that standard encourages better documentation and more disciplined reasoning.
  • For researchers, it protects the distinction between hypothesis and demonstrated support.
  • For attorneys, it provides a framework for evaluating whether an opinion can withstand meaningful scrutiny.

And for the court, it helps ensure that specialized knowledge assists the factfinder rather than simply asking the factfinder to trust the expert.

Sciatica is a collection of symptoms characterized by pain which extends down the length of the legs from the lower back. Approximately 90 percent of sciatica, or sciatic nerve pain, develops when a spinal disc herniation compresses a spinal nerve along the lumbar spine. Piriformis syndrome and pregnancy are other common causes of sciatica. Chiropractic care is an alternative, treatment option which focuses on the treatment of injuries and/or conditions associated with the musculoskeletal and nervous system. Patients describe how Dr. Alex Jimenez has helped them achieve sciatica relief through chiropractic care. Edgar M. Reyes and Truide Torres highly recommend Dr. Alex Jimenez as the non-surgical choice for sciatica.

INJURY HELP IN EL PASO (Auto Accident • Work Injury • Sports Injury)

Come by and visit us. We are available to take your call now: 915-412-6677

If you’re dealing with pain after a car crash, work incident, or sports injury, you deserve a clear plan—not guesswork. I’m Dr. Alex Jimenez (DC + Nurse Practitioner), and at Injury Medical Clinic PA in El Paso, we focus on thorough evaluation, conservative care when appropriate, careful documentation, and function-based recovery so you can get back to life with confidence.

WHY DUAL-LICENSED CARE MATTERS
Injuries often involve more than “just the spine”—joints, nerves, soft tissue, mobility, sleep, and stress can all be affected. My dual training supports a broader clinical view and more coordinated decision-making, including appropriate referrals when needed.

WHAT TO EXPECT
• Detailed injury evaluation (pain source + function limits)
• Movement and stability testing (mobility, weakness, coordination)
• Structured re-exams to track measurable progress

COMMON CONDITIONS WE SEE
• Whiplash/neck pain & post-accident headaches
• Mid-back and low-back pain (with or without leg symptoms)
• Shoulder strain, rib irritation, hip/SI joint dysfunction
• Knee/ankle sprains, postural changes, reduced range of motion

TREATMENT OPTIONS (INDIVIDUALIZED)
• Chiropractic care to restore motion and joint mechanics
• Soft tissue / myofascial therapies to reduce guarding & trigger points
• Rehabilitation + corrective exercise (core stability, balance, control, endurance)

PERSONAL INJURY DOCUMENTATION
If your case involves an auto or work injury claim, we keep care organized with clear findings, progress measures, and professional records when needed.
